Kerr is planning a series of posts over at the Volokh Conspiracy on this decision, and began by highlighting some important issues that could lead to reversal. Haven't read the opinion yet, but I plan to shortly. Be interesting to see if (and how) they dealt with the postcard/envelope analogy. Of course, allowing the emails to be intercepted could push more people to use encryption, which would be great.
